Definitions

Electronic Information System - Imigration Card (EIS.I Card)/ Automatic Border Passage (ABP)
One of Saphire privilege which enables Saphire members to fast track the immigration through Automatic Border Passage (ABP)

Automatic Border Passage (ABP)
Automatic gate to pass the border using the Saphire Card, provided exclusively for Participant.

Participant
The person who concluded the Saphire Participation Agreement with PT. Angkasa Pura Schiphol.

PT. Angkasa Pura Schiphol
PT Angkasa Pura Schiphol, having its registered office at Terminal F Arrival Hall Room F9P67 Soekarno-Hatta International Airport.

Saphire Services
The package of services offered specifically by PT. Angkasa Pura Schiphol to the Participants.

Preferred Security Lane
Special Lane security check of traveller and luggage at the airport exclusively intended for Participants

Preferred Airline Check In
Special check in counter provided by the participating airlines for the Participants.

Preferred Parking
Special parking area exclusively provided for the Participants

Saphire Participation Agreement
The agreement between the Participant and PT Angkasa Pura Schiphol with regard to Saphire Services

Saphire Card
Card with the chip (whether or not equipped with a magnetic strip) that enables the use of Saphire Services

Saphire Service Center
Where all the activities (enrolment, membership account closing, card replacement etc) related to Saphire Services shall take place.

Membership Annual Fee
Fee charged annually to the Participants by PT. Angkasa Pura Schiphol.

 

2.  

Applicability and Saphire Participation Agreement

2.1.  

These General Terms and Conditions apply to the Saphire Participation Agreement.

 

2.2.

The Saphire Participation Agreement is formed by PT Angkasa Pura Schiphol, upon acceptations of the application form filled in and signed by the potential Participant which acceptation is considered to have taken place at the moment the Participant receives the Saphire welcome package. If the Participant states at the Saphire Service Center that he wishes to become a member the start of the making of the iris scan shall be considered the moment of acceptation by PT. Angkasa Pura Schiphol of the application form filled in and signed by the potential Participant.
The potential Participant considered a Participant if all the process is already done and the Participant has already paid the Membership Annual Fee.
To the best of PT Angkasa Pura Schiphol’s knowledge the iris scan does not involve health risks, PT Angkasa Pura Schiphol shall provide Saphire Services exclusively to who are the rightful owners of a valid travel document (e g a Passport, KITAS, KITAP, Multiple Business Visa, Multiple Re-entry Permit)

 

2.3.  

After the formation of the Saphire Participation Agreement the Participant shall make an appointment with PT Angkasa Pura Schiphol for the making of a Saphire Card. To this end PT Angkasa Pura Schiphol will inter alia make an iris scan of both eyes, a fingerprint of both thumbs, and a photo of the Participant. The Participant shall give any assistance required. Subsequently PT Angkasa Pura Schiphol will convert the iris scan into a so-called template. In the event that it is impossible to make a good iris scan or fingerprints that meets the norms of PT Angkasa Pura Schiphol (as a result of the Participants specific features), no Saphire Card can be made for the Participant. In that case PT Angkasa Pura Schiphol shall terminate the Saphire Participation Agreement with immediate effect.

 

 
 
3.   Saphire Services

3.1.  

The range of Saphire Services offered is determined by PT Angkasa Pura Schiphol and shall include in any case Electronic Information System - Imigration Card (EIS.I Card)/ Automatic Border Passage (ABP), Preferred Security Lane, Preferred Parking, and Preferred Airline Check In.

 

3.2..

PT Angkasa Pura Schiphol shall notify the Participant of any extensions or changes to the range of Saphire Services offered.

 

 
 
 
4.  

Saphire Card

4.1.  

The Saphire Card shall be and remain the property of PT Angkasa Pura Schiphol. The Saphire Card is strictly personal, cannot be used by any other person but the Participant and is non transferable. The Participant shall not use the Saphire Card in connection with the professional and/or commercial transportation of persons or goods. Any changes or alterations made to the Saphire Card shall invalidate the Saphire Card with immediate effect.

 

4.2..

Upon expiry of the period of validity of the travel document (e g a passport, KITAS, KITAP, Multiple Business Visa, Multiple Re-entry Permit) of the Participant used in the application as well as in case of theft or loss of such travel document the Participant's right to make use of EIS.I Card/Automatic Border Passage (ABP) shall terminate. Upon acquisition of a new travel document (e g a passport, KITAS, KITAP, Multiple Business Visa, Multiple Re-entry Permit), the Participant shall report this or submit the relevant documents and copies to PT Angkasa Pura Schiphol. Whereupon PT Angkasa Pura Schiphol shall make an effort to allow renewed Automatic Border Passage with the Saphire Card within a reasonable period of time to this end the Participant has to submit the new travel document for control to the Saphire Service Center at PT Angkasa Pura Schiphol

 

 
 
4.3.  

The Participant shall immediately notify PT Angkasa Pura Schiphol in the event of loss and/or theft of the Saphire Card. The Participant in writing to PT Angkasa Pura Schiphol must confirm the notification of loss or theft. At the first request of PT Angkasa Pura Schiphol, the Participant shall report the loss and/or theft of the Saphire Card to the police and the Participant shall provide PT Angkasa Pura Schiphol with a copy of such report. After the first notification by the Participant to PT Angkasa Pura Schiphol of the loss and/or theft of the Saphire Card PT Angkasa Pura Schiphol shall make an effort to render impossible the use of the lost or stolen Saphire Card as soon as possible. A new Saphire Card shall subsequently be made available to the Participant for which purpose a new iris scan will have to be made.

 

4.4.

In the event that the Saphire Card is damaged, the Participant shall return it to PT Angkasa Pura Schiphol. A new Saphire Card shall then be made available to the Participant if PT Angkasa Pura Schiphol concludes that the damage in question renders all further use of the card impossible. In order to make a new card, PT Angkasa Pura Schiphol will make a new iris scan at a time to be agreed upon with the Participant.

 

4.5.

At the end of the technical life of the Saphire Card following notification thereof from PT Angkasa Pura Schiphol, the Participant shall make an appointment with PT Angkasa Pura Schiphol to have a new Saphire Card made. The provision of Article 2.3 shall apply by analogy.

 

5.

Payment

5.1.  

In exchange for the provision of the Saphire Card, PT. Angkasa Pura Schiphol shall charge a fee to the Participant directly upon application which fee shall be based on Rupiah or other currency (the current rates) for Saphire Services. These rates shall be made public by PT Angkasa Pura Schiphol in a manner sufficiently knowable, including in any case by publication on the Saphire website (www.saphire.co.id) The rates made public by PT Angkasa Pura Schiphol shall be in force throughout expiry of each card.

 

5.2..

After the payment for the first year that payable upon application, the participant must ensure every year that PT Angkasa Pura Schiphol shall receive the amount due prior to the subscription year to which the payment relates. In the event that PT Angkasa Pura Schiphol did not receive the fee in time, the Participant shall be in default and PT Angkasa Pura Schiphol shall be entitled to suspend Saphire Services.

 

 
 
5.3.  

PT Angkasa Pura Schiphol, at anytime, may change the Membership Annual Fee. PT Angkasa Pura Schiphol shall notify the participant of any such changes before the effective date of any subsequent subscription year. In the event of an annual fee increase, the Participant shall have the right – contrary to the provisions of article 9 – to cancel the Participation Agreement in writing with effect from the subscription year that the changed price relates to, without observing the notice period of two months.

 

6.

Other obligation of the Participant

6.1.  

The Participant shall only have the right to use Automatic Border Passage if (a) the Participant himself/herself subsequently departs from Soekarno-Hatta International Airport by airplane, or has arrived at Soekarno-Hatta International Airport by airplane, and (b) the participants carries a valid travel document (e.g. Passport, KITAS, KITAP, Multiple Business Visa and Multiple Re-entry Permit) and travel ticket (airline ticket or boarding pass) that may be checked.

 

6.2..

The participant shall follow (a) all instruction to be given by or on behalf of PT Angkasa Pura Schiphol for the purpose of order and safety at the airport and (b) all instruction to be given by the Immigration in the interest of border control.

 

 
 
6.3.  

PT Angkasa Pura Schiphol is entitled to block the use of the Saphire card by the Participant, whether or not temporarily, with immediate effect in the event that the Participant fails to comply with instructions referred to in the previous paragraph, abuses the Saphire card, or acts in violation of any part of the Saphire participation Agreement.

 

7.

Personal Data

7.1.  

PT Angkasa Pura Schiphol collects the personal data that the participant filled in on the application form, biometric data, as well as data on the use of the Saphire Card by the Participant. PT. Angkasa Pura Schiphol will keep all personal data confidentially.

 

7.2..

In Saphire Card and Saphire system : the card number, the template of the iris scan, finger scan, the photo, the name, place of birth and date of birth of the participant are incorporated, as well as data derived there from that are required for providing Saphire services.

 

 
 
7.3.  

The purpose of processing personal data within the scope Saphire Services is to support and facilities to participants the use of Soekarno-Hatta International Airport facilities in any designated way, and to grant preferential treatment to Participants in the broadest possible sense, based on careful examination of the data on the Participant’s use of Saphire card.

 

7.4.

Within the scope of the above mentioned purposes; the following personal data will be processed in any case when providing Saphire services:
- the date and time at which the Saphire Card is inserted into card reader of the Automatic Border passage, Immigration shall be provided with personal data required for the performance of its duties.

 

7.5.

After the Participants has given his/her approval on the application form, PT Angkasa Pura Schiphol can grant the participant tailor made Saphire benefit in order to perfect preferential treatment.

 

7.6.

If the participant objects to receiving benefits from third parties, the participants can make this known by sending and email to info@saphire.co.id or by calling +62-21-55910910.

 

7.7.

PT Angkasa Pura Schiphol will, except in cases where the law so requires and in cases mentioned in this Saphire Participation Agreement, not provide the Participant’s personal data to other person or institution outside PT Angkasa Pura Schiphol in case the Participant’s does object. PT Angkasa Pura Schiphol will undertake every effort to regularly check personal data for accuracy, and to remove old, no longer relevant data in time.

 

7.8.

The Participant can inspect his/her own personal data after having made a written request to that effect to PT Angkasa Pura Schiphol. At the request of the participant, PT Angkasa Pura Schiphol shall provide an overview of the participant’s data collected within the scope of the Saphire services. The Participant can request PT Angkasa Pura Schiphol, if desired, to correct inaccuracies, to add missing data, and to remove irrelevant or superfluous data. 7.9.

The Participant shall immediately notify PT Angkasa Pura Schiphol in writing of any change in his/her personal data as mentioned on the application form. PT Angkasa Pura Schiphol shall notify the participant of any changes in its address details.

 

8.

Liability

8.1.  

The liability of PT Angkasa Pura Schiphol for damage that is in any way connected with the Saphire Card and/or Saphire Services shall be limited to the Membership Annual Fee to be paid annually by the Participant. This limitation of liability shall not apply if and insofar as PT Angkasa Pura Schiphol can be sued on the basis mandatory applicable law (e.g. product liability law) as well as in the event of wilful intent or gross negligence on the part of PT Angkasa Pura Schiphol or its executive staff.

 

9.

Duration and termination

9.1.  

The Saphire Participation agreement is concluded for an unlimited period of time. Either party shall have the right to terminate the Saphire participation Agreement in writing with due observance of a notice period of two months.

 

9.2..

In the event the participant fails to comply with the provisions of the Saphire Participation Agreement, PT Angkasa Pura Schiphol may dissolve this agreement without judicial intervention and waive the stipulation of Article 1266 and Article 1267 of Indonesian Civil Code with immediate effect in whole or in part, if such failure justifies dissolution according to PT Angkasa Pura Schiphol’s reasonable judgement. In that case, PT Angkasa Pura Schiphol shall have the right to set off any amounts already paid by the Participant against the cost made by PT Angkasa Pura Schiphol in connection with the Participant’s failure and the dissolution of the Saphire Participation Agreement.

 

 
 
9.3.  

After termination of the Saphire Participation Agreement, the Participant must return the Saphire card upon termination of the Saphire Participation Agreement to PT Angkasa Pura Schiphol.

 

10.

Choice of law and resolution of disputes

The Saphire Participation Agreement is subject to the law of the Republic of Indonesia. Either Party has to submit a dispute to the competent Indonesian court in Tangerang, Banten for resolution in the event that such Party is of the opinion that the conflict can not be solved by mutual consolation.
